Different pieces of information, which collected together can lead to the identification of a particular person or entity, also constitute personal data.Printed Item(s): Each discrete printed item is counted as one (1) printed item. The License Term may be a fixed term, a perpetual term or a limited term for certain editions.Personal Data: Personal data is any information that relates to an identified or identifiable living individual or recognized legal entity. The source code of a program is specially designed to facilitate the work of computer programmers, who specify the actions to be performed by a computer mostly by writing source code. “Software Product” shall also include any Support and Maintenance Services releases and updates provided to you under this Agreement.Source Code means any collection of code, with or without comments, written using a human-readable programming language, usually as plain text. Similarly, if content is merged into a template to generate one or more pages of a pdf file, such as receipts, tags, invoices or packing slips, each discrete item on each individual page is counted as one (1) printed item.Product Key Code: means the valid license key(s), license code, uniquely identifiable user registration or Software activation code (“PKC”) provided to you at the time of purchase.Software: means the proprietary Seagull Scientific software provided in connection with this Agreement in either Source Code or machine code form (or as otherwise specified in any related License Certificate), as more fully described in the Documentation.
All undefined names of Software Products have the meanings given to them in the Documentation.User Content: means any data, email address, file attachments, text, images, reports, personal information, or other content that is uploaded or submitted to the online Portal by you and is processed by Seagull Scientific on your behalf.2.1 Seagull Scientific Software Activation. Alternatively, source code may be interpreted and thus immediately executed.Unless otherwise noted, the Software, Support and Maintenance Service, and Documentation are referred to collectively herein as “Software Product(s)”. Your registration information must be accurate, current, and complete. You must register for an account with us and register your product(s) under that account, in order to place orders or access or receive Software and/or Support. Seagull Scientific Software will only license such use as expressed in Usage Metrics determined by the type of license you have either purchased or, in the case of an Evaluation Edition, for which you have been granted a license by Seagull Scientific or an Authorized Partner.2.4. Your license to Seagull Scientific’s Software Product will be subject to and restricted by usage metrics such as the number of printers used, or number of items printed within a specific time period.

Seagull Scientific may collect data that is not Personal Data, e.g. No Personal Data is collected in a manner to correlate with any identified individual or recognized entity.
Software Product that allows you to use the Software Product for a pre-determined and/or time-limited term provided you comply with the terms of this Agreement, as it may be modified from time to time. The following Software Products are available on a subscription license: Pro Automation and, Enterprise.2.6.3. Software Product that allows you to use the Software Product for a specified license term provided you comply with the terms of this Agreement, as it may be modified from time to time. The following Software Products are available on a perpetual license: Ultralite Pro Automation and, Enterprise.2.6.2 Subscription License. Software Product that may be licensed to you for as long as you comply with the terms of this Agreement, as it may be modified from time to time. You may review Seagull Scientific’s data privacy policy on our website.2.5 Seagull Scientific may access or disclose information about you or your use of BarTender Software: (a) when it is required by law (such as when Seagull Scientific receives a valid subpoena or search warrant) (b) to respond to your requests for customer service support or (c) when Seagull Scientific, in its discretion, think it is necessary to protect Seagull Scientific’s rights, property, or personal safety, or that of Seagull Scientific’s users, or the public.2.6 Seagull Scientific License Types and Specific Restrictions2.6.1 Perpetual License.
